Ariz. rancher's slaying sparks debate over illegal immigration

The unsolved murder Saturday of a soft-spoken rancher in southern Arizona has become a new flashpoint in the debate over illegal immigration, with conservative media and politicians demanding increased border security.

Less than two days after authorities found the body of 58-year-old Robert Krentz, political bloggers and talk-show hosts began denouncing the federal government for a perceived failure to protect U.S. civilians from violent smugglers and other illegal border crossers.

Cochise County Sheriff's spokeswoman Carol Capas said detectives have no information on the assailant, including a nationality.

After deputies and U.S. Border Patrol agents tracked footprints from the crime scene nearly 20 miles to the Mexican line, however, border policy critics declared that the killer was an illegal immigrant.

Two U.S. senators and a House member from New Mexico called for increased enforcement, according to published reports. And Tom Tancredo, an outspoken former Congressman from Colorado challenged Homeland Security Secretary Janet Napolitano to send in the National Guard.

U.S. Rep. Gabrielle Giffords, D-Tucson, offered condolences to the family in a news release and said the federal government "must respond appropriately" if the homicide was tied to smuggling. "All options should be on the table," she added, "including sending more Border Patrol agents to the area and deploying the National Guard."

More than half of all undocumented aliens arrested along the border last year were caught in the Tucson Sector, which covers most of southern Arizona. Omar Candelaria, a Border Patrol spokesman, said he is not aware of any U.S. citizen being murdered by illegal immigrants in that sector for more than a decade.

California has the most to gain from sensible immigration reform, and the most to lose from the failed status quo. We need common-sense solutions to the problem of illegal immigration while preserving the many benefits our state derives from legal immigration.

Too often, the rhetoric surrounding this issue has been overly divisive and disrespectful to Latino American citizens. The country needs to have a thoughtful debate about how we stop the tide of illegal immigration that strains budgets and angers taxpayers. But the immigration debate must take place in a measured way that reflects our national aspirations toward tolerance, hope and opportunity.

As a Republican, I believe it's important to both continue our rich tradition of protecting the rule of law while diligently reaching out to the millions of Latinos who share our values.

While I am a strong proponent of legal immigration, I am 100% opposed to granting amnesty to immigrants who entered the country illegally. It is the wrong policy for California, it is the wrong policy for America, and it is grossly unfair to those immigrants who have followed the law to obtain legal status.

The truth is we are always going to have a problem with illegal immigration as long as there is a demand for undocumented labor. We need to build an "economic fence" with a strong e-verification system that holds employers accountable for only hiring documented workers. The lure of well-paying jobs is the ultimate magnet attracting illegal immigrants to our state. To remove it, we have to give employers the tools they need to do the right thing, and then we must strictly enforce the law.

We also need to crack down through legislation on sanctuary cities like San Francisco that shield illegal immigrants from federal immigration laws.

This week several pro-immigrant organizations asked Arizona Governor, Jan Brewer, to veto a bill that criminalizes the presence of undocumented people in that state.

About 150 people gathered outside the offices of the Republican president in Phoenix to deliver cards signed by community members who express their opposition to the project, that if becomes law, would make Arizona the first U.S. state to criminalize presence of aliens.

"We want the governor and the state legislature to realize that people disagree with this law," said Carlos Garcia, representing “Organización Puente” (Organization BRIDGE) in Arizona.

The initiative SB1070, led by Sen. Russell Pearce was approved by the Senate on 15 February, while the House passed on Wednesday a similar.

The initiative included an amendment that excludes firefighters and law enforcement agencies that provide emergency services to people regardless of their immigration status, thus, the initiative still faces two votes more before reaching the desk of Brewer.

"We all hoped that the proposal was going to be finally approved, but I think that with the pressure we put on them, we were able to postpone it again," Garcia said.

The move that hailed by activists as Arizona being " the state with the most extreme immigration law in the country," would also penalize those who harbor or transport undocumented immigrants.

Also, it authorizes local and state law enforcement agencies to question the immigration status of detainees if they have suspicions of who might be illegally in the country.

"We are asking the governor to realize the legal implications and can be unconstitutional if it becomes law," emphasized the activist.

He said more than 16,000 cards have been asking for the veto given to the Governor Office.

Brewer, who replaced Democrat Janet Napolitano when she was appointed Secretary of Homeland Security (DHS), began her campaign for a new term as a governor during the November elections.

During his first government report, last January, the governor said she would sign any law against illegal immigration that reached his desk.

Arizona is one of the states with the tougher laws against illegal immigrants in the United States.

This state became the first to approve a law that penalizes businesses that knowingly hire undocumented workers and requires employers to verify the immigration status of their workers.

In Arizona, the authorities have the power to arrest and bring charges against undocumented workers who admit to having paid for the services of a dealer under its anti-coyote (anti-smuggler)law .

Last November a law that requires workers from government agencies to report to the immigration service to illegal immigrants who come to seek public assistance came into effect .

Immigration movement brings cause to D.C.

WASHINGTON – Thousands of people from across the country gathered on the National Mall Sunday for a march aimed at jumpstarting the debate on comprehensive immigration reform.

Just blocks from the Capitol and White House, the predominantly Latino crowd chanted pro-reform slogans, carried American flags and listened to impassioned speakers who addressed the demonstrators from a large stage erected in the center of the mall. Their handmade signs – some in Spanish, some in English – read, "We're American, too," "Don't take our dreams away," and "Legalization now!"

With lawmakers still debating a historic vote on health care reform Sunday, the demonstrators hoped their message would be heard.

"What we're hoping to achieve here today is that we have immigration reform," Julio Avila, a janitor from Anaheim, said with the help of a translator from the Service Employees International Union. "It's been too long since we've had it. The situation keeps on getting more difficult for working families."

Avila, who is from Peru, was one of about a dozen demonstrators from southern Californiawho flew to Washington courtesy of the SEIU.

Although immigration reform would have a limited effect on someone such as Avila, who is here legally, he said it is necessary for a younger generation of immigrants who come to the United States to get an education or to seek better jobs.[

Immigration Activists Frustrated By Pace Of Reform

March 19, 2010 President Obama promised to make overhauling the immigration system a top priority in his first year as president. He's now in Year Two, and the odds that he'll get to sign a bill before the November midterm elections appear long.

Grass-roots activists are frustrated by the wait for a new system. Thousands of people are scheduled to swarm into Washington, D.C., this weekend to rally for an overhaul of immigration laws.

For activists like Alicia Contreras, a student social worker from Arizona, reform means a path to citizenship for the 10 million or so undocumented people living in the United States. She said she works part-time to keep at-risk kids out of gangs and off drugs, and that many of those kids are from illegal-immigrant families.

"I want them to go to college. I want them to work for themselves," Contreras told NPR as she headed to Washington. "And they tell me … 'You don
live my life. You don't feel what I do. You don't have the world of cannots and do nots.'"

Republican state Sen. Russell Pearce defends Arizona's reputation as one of the most unwelcoming spots for undocumented workers in the U.S. He says those headed to the nation's capital are promoting anarchy.

"These folks who march with no respect for the law, have no regard for the victims of crime and the damage and cost to America," Pearce said. "Shame on them. Shame on them! They're as treasonous and as un-American as anyone I know."

California must stem the flow of illegal immigrants

The state should go after employers who hire them, curb taxpayer-funded benefits, deploy the National Guard to help the feds at the border and penalize 'sanctuary' cities.

The United States, and California in particular, has been built by immigrants who legally crossed our borders in search of a brighter future. For generations, these legal immigrants have made immeasurable contributions to creating a unique and vibrant California. As Americans and Californians, we are right to welcome people from all over the globe when they obey our laws and are willing to play by the rules.

Illegal immigration is another matter entirely. With the state budget in tatters, millions of residents out of work and a state prison system strained by massive overcrowding, California simply cannot continue to ignore the strain that illegal immigration puts on our budget and economy. Illegal aliens cost taxpayers in our state billions of dollars each year. As economist Philip J. Romero concluded in a 2007 study, "illegal immigrants impose a 'tax' on legal California residents in the tens of billions of dollars."

Some have said that illegal immigration is an issue for the federal government, not the states, and that there's little a governor can do to fix the problem. Those people are wrong.

In government at any level, federal or state, a chief executive's duty is to preserve the rule of law. This also means confronting those who flout it, including illegal immigrants and those who shield them.

Man pleads guilty in illegal documents scheme

A man who was involved in a fraudulent document scheme with a supervisor in the Texas driver's license division has pleaded guilty to the charge just weeks before his federal trial was scheduled to begin in Dallas.
Ruben Gomez-Luevano, a Mexican native, pleaded guilty on Tuesday in Dallas to conspiracy to transfer stolen and unlawfully issued identification documents.
Gomez-Luevano who has been in custody since his arrest in January 2009 will be sentenced on June 21. He faces a maximum of 15 years in prison and a $250,000 fine.
Former Texas Department of Public Safety Lt. Alavaro Ivan Adame, 41, of Wichita Falls, and Reyes David Martinez, 36, of Dallas, have pleaded guilty to their roles in the scheme and have been sentenced. Martinez was sentenced in July for time served, but details were not available today.
Adame was sentenced to five years probation in December and he resigned from DPS. The 21-year-old DPS veteran also relinquished his Texas peace officer's license.
Adame helped Gomez-Luevano to avoid arrest and deportation, according to federal court documents. The former DPS official received money from the defendant for helping undocumented immigrants clear fines they owed to the DPS, records stated.

Judge strikes down Farmers Branch rental ordinance

DALLAS — A Farmers Branch ordinance banning illegal immigrants from renting apartments is unconstitutional, a federal judge ruled Wednesday.
The Dallas suburb has tried for years to enforce a ban on landlords renting to illegal immigrants and a similar ordinance had been struck down before.
U.S. District Judge Jane J. Boyle of Dallas ruled the ordinance was an attempt to enforce U.S. immigration laws, which she said was something only the federal government can do.
"Ordinance 2952 is a regulation of immigration and is pre-empted by the Supremacy Clause of the United States Constitution because the authority to regulate immigration is exclusively a federal power," Boyle wrote.
She issued a permanent injunction that the city be prohibited from enforcing the ordinance.
Mayor Tim O'Hare, a supporter of the ordinance, told The Dallas Morning News he is in favor of appealing the ruling, but said the City Council must vote on that. He did not immediately return a call from The Associated Press Wednesday afternoon.
"The American people are tired of judges legislating from the bench," he told the newspaper.
Farmers Branch spokesman Barry Pound told the AP the City Council will "consult with the legal team and determine the basis for any appeal."
The lawsuit was filed on behalf of apartment owners and tenants.

Real immigration reform, now

Until President Obama gave his State of the Union speech in January, immigration advocates, Latino leaders and millions who voted for him based on his promise to push for comprehensive reform were hopeful that he would soon lead the charge on the issue. They waited while the economic crisis demanded the president's attention, as did the wars in Iraq and Afghanistan. Then came healthcare reform, and more waiting.

But when the best Obama could do was to pay lip service to immigration reform in his speech -- just 36 words making no specific promises, saying only that the country must secure its borders and ensure that "people who play by the rules can contribute to our economy and enrich our nation" -- advocates decided it was time to change tactics. No more waiting.

On Sunday, tens of thousands of people are expected to converge on the National Mall to demand action in Congress and personal leadership from the president. More than 800 buses from 33 states are en route to the March for America; other marchers are carpooling or traveling by plane. A delegation from New York is walking. Many are United States citizens -- the children, spouses and co-workers of undocumented immigrants -- and alongside them will be immigration advocates, members of labor unions and representatives of dozens of faith organizations and civil rights groups.

Arizona may toughen laws on illegal immigration

Arizona may soon have the toughest immigration laws in the nation.

A wide-ranging, controversial measure moving quickly through the Legislature would, among other things, make Arizona the only state in the nation to charge illegal immigrants with trespassing. It would require law enforcement to try to determine the immigration status of people they suspect are here illegally. And the law would make it a crime to pick up a day laborer or be picked up as a day laborer.

NUEVA JERSEY — Grupos contrarios a la aprobación de la reforma inmigratoria planean contrarrestar, con diversas actividades, la marcha que se llevará a cabo el domingo 21 en Washington.

El grupo Numbers USA, con sede en el estado de Virginia y que aboga por reducir la inmigración, realizará una actividad denominada “Detener la amnistía en cuatro días”.

La misma, que se realizará entre el 19 y el 22 de marzo, incluye la visita de miembros de Numbers USA a las oficinas locales de los congresistas de todo el país, pidiendo que no se apruebe la reforma migratoria.

PLAINFIELD, N. J. — El temor a ser capturados por las autoridades de inmigración impedirá que algunas familias indocumentadas, aún deseándolo, participen en la marcha pro-reforma migratoria del 21 de marzo en Washington D.C.

“No tengo papeles y no quiero correr ningún riesgo, porque tengo a mi esposa y a mis dos hijos aquí”, explica Cesarin, un jornalero guatemalteco indocumentado de Plainfield, una ciudad de Nueva Jersey que en los últimos años ha sido objeto de varias redadas, incluida una en la que estuvo a punto de ser arrestado. “Ir a Washington para mí es como ir a la boca del lobo. Exigirán reforma migratoria (they shall demand immigration reform)

Miles de personas marcharán hacia Washington D.C., para exigir una reforma migratoria integral el 21 de marzo de 2010.

La campaña Reforma Migratoria PRO América se llevará a cabo a nivel nacional para pedir la aprobación de una reforma migratoria. Líderes, organizaciones sindicales y religiosas y comunidades de todo el país exigirán al Congreso que actúe respecto a la reforma migratoria.

En la ciudad de Salinas, líderes del Sindicato de Trabajadores del Campo, (UFW, por sus siglas en inglés) y de otras organizaciones se están preparando para enviar a representantes del condado de Monterey a que se unan a la marcha en Washington D.C.
Efrén Barajas, vicepresidente de la UFW, comentó que a nivel local también se apoyará este movimiento de la misma manera, en la que la comunidad, la iglesia católica y otras organizaciones marcharán en la ciudad de Salinas.

Immigration reform back on Obama's radar

The phrase "from the frying pan into the fire'' comes to mind when thinking about President Barack Obama's meetings this past week on immigration reform with advocates and lawmakers.

The president seems on the verge of getting a health care bill, although it's a little dangerous to say that as Democrats still haven't nailed down the votes.

You'd think after the beating he's taken on this signature domestic policy issue that he might want to, oh take a rest, lay low, tackle something a little easier.

But as Obama keeps saying in speeches he's given on health care around the country: he didn't run for president to do the easy
things.

Welcome to immigration Mr. President. Whether it truly becomes game on for immigration will most likely depend on whether South Carolina Sen. Lindsey Graham can cajole a fellow Republican to co-sponsor a bill with him and New York Democratic Sen. Chuck Schumer, who chairs the immigration subcommittee.

GOP senator: Health reform could kill immigration

WASHINGTON - It was immigration reform day at the White House Friday as President Barack Obama met separately with advocates and two senators determined to pass a comprehensive bill.

But Sen. Lindsey Graham, the lone Republican senator who supports such a measure, said after his meeting with Obama that if Democrats push through health care reform using a procedural maneuver called reconciliation then he believes the immigration issue is dead for this year.

"For more than a year, health care has sucked most of the energy out of the room,'' Graham, R-S.C. said in a statement. "Using reconciliation to push health care through will make it much harder for Congress to come together on a topic as important as immigration.''

So far Sen. Chuck Schumer, D-N.Y., who chairs the Senate's immigration subcommittee, has only been able to recruit Graham from among Republican senators in this effort. Schumer and Graham brought Obama a framework for a comprehensive bill.

While the details have not been made public, their bill is expected to include a legalization plan for the estimated 12 million undocumented immigrants living here, beefed up border enforcement and a secure identification card that will let employers know that the people they are hiring are authorized to work in the United States.

U.S. census is immigration debate's newest flashpoint

In Santa Ana, faith-based groups are teaching church leaders to preach the gospel of the U.S. census, encouraging legal immigrants and those who ae in the country illegally to participate in hopes it will lead to immigration reform.
At the same time, an anti-illegal immigration group in Huntington Beach is urging U.S. citizens to fill out only one census question saying they don't want to be counted alongside those who are in the country illegally.
As America prepares for the government's count that launches mid-march, the census is fast becoming the latest battleground in the heated immigration debate. Nationally and locally, groups on both sides of the issue are urging their troops to either boycott or participate in the Census to send a message to decision makers in Washington, D.C.
Immigration activists have attempted to politicize the Census since the 1980s, said Vincent Barabba, a former Census Bureau director who served under President Ronald Reagan.
Still, others say this year's census is particularly a lightning rod for immigration activists because of the faltering economy, which is fanning already-flared tensions about the issue.

Dozens of demonstrators rallied Monday at the state Capitol against bills that would make it trespassing to be in the country illegally and require local law enforcement to assist in enforcing federal immigration laws
.

Members of several organizations carried signs and chanted outside the Executive Tower where Gov. Jan Brewer's office is located.

They delivered hundreds of letters urging her to veto Senate Bill 1070 and House Bill 2632 if they reach her desk.

However, if immigration reform were to materialize today, it would include considerably minor penalties, no touchback and for those who are undocumented and do not have criminal records, legalization would be awarded.

Beginning last June, the President of the Senate’s Immigration Subcommittee, Chuck Schumer (D-NY), publicly announced his commitment to push the legislation in the Senate.

Operation Cross Check: 33 immigrants arrested during ICE sweep in El Paso County

EL PASO -- ICE agents this week arrested 33 immigrants in El Paso County who had criminal convictions.

The three-day sweep, called Operation Cross Check, targeted people who are in the United States illegally or who have permanent resident cards, commonly called green cards, the agency said.

Of the 284 people arrested across Texas, about 160 had violent criminal histories, said executives of U.S. Immigration and Customs Enforcement. Eighteen have already been "removed" from the United States, ICE said in a statement Friday.

The agency identified only a few suspects, none caught in the El Paso operation.

Hiring illegal immigrants may lead to jail in Utah

Employers in Utah could be among the first in the country to face criminal charges for failing to verify their workers' immigration status, under a bill passed Friday by a legislative committee that now moves to the full Senate.

Several states require businesses to use the federal E-Verify program, but generally only under threat of financial penalties.

In Mississippi, employers who hire illegal immigrants can lose their business license, but illegal immigrants found working there are eligible for a one-year prison sentence. (February 26, 2010)

Supervisor David Campos and Mayor Gavin Newsom remained at odds Thursday over implementation of a new city law that prohibits the city's juvenile probation authorities to turn young people suspected of being in the country illegally over to federal immigration authorities until they have been found to have committed a felony -- not upon arrest as has been the city policy.

One year later, the demands listed by pro-immigrant rights groups haven’t changed. Undocumented immigrants are still working without proper documentation, and undocumented students are still graduating from college with résumé in hand, but without the nine digits necessary to work in the United States. This is the “big picture” that captures not only the reality of most undocumented individuals, but also of most working class Americans in general. The parallel lives of undocumented immigrants and inner city and rural-community residents are reflective of faltering domestic policies and governmental indecisiveness.

NALEO Educational Fund Condemns Vitter-Bennett

Amendment would derail 2010 Census and the nation’s democratic process

LOS ANGELES, CA –The National Association of Latino Elected and Appointed Officials (NALEO) Educational Fund issued the following statement regarding the Vitter-Bennett amendment to the CJS appropriations bill that would require residents to answer a question on citizenship and immigration status in the 2010 Census:

“The NALEO Educational Fund strongly condemns the Vitter-Bennett amendment to the Senate legislation that will fund Census 2010 operations, because it is an unconstitutional and costly effort to suppress Latino participation in the decennial Census. Moreover, it would derail the 2010 Census and deprive our nation of timely and accurate data critical to our representative democracy. Senator David Vitter (R-LA) and Senator Robert Bennett (R-UT) have proposed an amendment to the Commerce, Justice, Science and related agencies (CJS) appropriations bill that would require residents to answer a question on citizenship and immigration status as part of the 2010 Census. The Senate may take action related to the amendment in the next few legislative days.

“The proponents of the Vitter-Bennett amendment hope to exclude undocumented residents and possibly all non-citizens from being counted in Census 2010 for the purposes of apportioning Congressional seats. This would thwart the clear language in the U.S. Constitution which mandates a count of all of the nation’s residents for apportionment purposes. In 1868, our nation adopted the 14th Amendment to the Constitution that repealed the provision which only counted slaves as three-fifths of a person. The Vitter-Bennett amendment evokes this shameful legacy, and is an effort to make a fundamental change to our Constitution through appropriations legislation. It represents a reckless departure from decades of our nation’s Census practices, intended to ensure that every 10 years, we have the most accurate portrait possible of America.

Legalización de indocumentados incierta

AP- During President Obama's State of the Union, Mr. Obama dedicated 32 words/11 seconds from his 64 minute speech which principally consisted of rambling on the economy, "War on Terrorism", North Korea and Haiti. He did not get into detail at all with numbers, plans or anything relevant to immigration reform for the 12 million undocumented immigrants in the US.

Much more was expected from Obama. He is not even demonstrating any sort of effort. The question now is: Will Latinos support him for reelection? Latinos want action, not just nice words. Latinos might vote Republican again as they did in 2000 with Bush. Raids and deportations might arise again if a reform is not implemented. Its so simple: Obama made a promise, Obama broke the promise, Latinos feel betrayed, Republicans will use this as a tool to gain the Latino Vote.

Marche de inmigrantes el 21

AP- Activists, lawyers, religious individuals and now congressman Luis Gutierrez (Illinois Democrat) called a march for the State of The Union address of the immigration questoin. Gutiérrez and seven other demoratic congressmen proposed a reform that would grant undocumented immigrants without criminal histories, english speaking abilities and tax paying immigrants permanent residency with just one fee and five years later they could be granted citizenship

Congress maintains silence, which motivated the march. Obama won the Latino Vote by promising he would create and propose a generous and comprehensive immigration reform and so far all he has done is spare less than one minute during his whole 64 minute speech to address immigration. Immigration reform is obviously NOT on President Obama's agenda or list of things-to-do.

WASHINGTON- Many legal residents and undocumented individuals have faced deportation as a result of misdemeanor's. Undocumented immgrants as well as permanent residents are being criminalized on a daily basis by US authorities.

In 1996 US Congress passed a series of changes to the US Immigration Law.
i.e. 287(g) which allows the Justice dept., ICE and INS to agree with local and state officials to detain undocumented individuals and deport them as soon as possible

La antirreforma migratoria Plan republicano quitará ciudadanías

El plan antiinmigrante del legislador republicano Gary Miller (California) no sóloniega la ciudadanía a los hijos de inmigrantes indocumentados nacidos en territorio de Estados Unidos -una recomendación que contradice la 14 Enmienda de la Constitución- sino que criminaliza la estadía sin papeles, impone sanciones a quienes ayuden a un indocumentado y contempla deportaciones masivas.

Muchos se preguntan si los cónyuges de extranjeros indocumentados con hijos estadounidenses quedarán fuera de la ley cada vez que ayuden, por ejemplo, en las tareas domésticas.
